An analysis of FIDIC red book contractual framework applied to underground works

FIDIC red book contractual framework is widely used in civil works contracts worldwide. Nonetheless some clauses deserve to be revised to allow their correct application to underground works. In particular the geologic risk sharing principles are not integrated in FIDIC standard contract. On the other hand, about risks other than geology related ones, the FIDIC framework affects some of them completely to one party without a real risk sharing philosophy. Some clauses have thus to be modified or more detailed. But the clauses modification has to be done carefully, because of the risk to jeopardize the risk-sharing equilibrium of the contract. In this paper an overview of the FIDIC contractual framework is done and its applicability to underground works. Some suggestions are issued when managing an underground project under FIDIC environment.
